Chapter 7 Means Test

In order to file for Chapter 7 bankruptcy, you must pass what is known as a "Means Test." This test essentially checks your household income against your state's median income to determine if you have enough disposable income to repay your debts. If your household income is below your state's median income level, you pass the means test and can file for Chapter 7.

The means test does take into account any recent or upcoming changes in your life, including recent unemployment, in addition to the size of your family and your essential expenses. Before taking the means test, it is important to gather up all documentation related to your income from the past six months.

If you do not pass the means test, you will have to wait an additional six months before attempting to file for Chapter 7 again. Alternatively, you can file for Chapter 13 bankruptcy instead.
